The Federal Court of Canada

This lawsuit in the Federal Court is without precedent.
 
The law says the Federal Court has jurisdiction to in proceedings in which relief is sought against any person for anything done or omitted to be done in the performance of the duties of that person as an officer, servant or agent of the Crown. Federal Court Act Section 17 (5) (b) 

When Prime Minister Chretien and/or his colleagues Justice Minister Rock, Justice Minister McLellan or others ordered the judges in British Colubmia and Alberta to make perverse rulings against Mr. Carten and Ms. Gibbs, they placed themsleves and those judges under the jurisdiction of the Federal Court.    

When Prime Ministers Chretien and Martin and/or their colleagues refused to do their duty to treat Sun Belt Water Inc. "fairly and equitably" as required by the provisions of the NAFTA, they placed themselves under the jurisdiction of the Federal Court.

The British Columbia government, the Law Society of British Columbia and the other Defendants would prefer that the Carten /Gibbs lawsuit were filed in the Supreme Court where they control the system through an established network of crooked agents.  

This Federal Court lawsuit has the potential to change, forever, the judicial landscape in Canada.   

Federal Court Prothonotary Roger Lafreniere

The Federal Court lawsuit was filed in Ottawa because the legal culture in Vancouver reeks with corruption.  
Unfortunately, an obscure prothonotray in Vancouver, Roger Lafreniere, appointed by Prime Minister Jean Chretien and Justice Minister Anne McLellan, intervened and decided he would take over management of the case.
The Plaintiffs complained, said he was unqualified and too close to the Liberal Party and predicted he would find agaisnt them which he did after stalling the case for 23 months.  The decision of the prothonotary is under appeal and the matter must be reviewed "de novo" by a Federal Court judge.
Mr. Lafreniere resides in Vancouver and is subject to threat, intimidation, and blackmail by orgainzed crime inside government offices in the Vancouver Victoria area.

Chief Justice of the Federal Court

The Chief Justice of the Federal Court of Canada is a gentleman named Allan Lutfy and on February 18, 2010, Chief Justice Lutfy decided to do what is right. 

Over the objections of lawyers representing the Governments of Canada and British Columbia, two of Canada's largest law firms, McCarthy Tetrault and Lang Michener, two Canadian Law Societies, Alberta and British Columbia, the Canadian Judicial Council and several judges, and one of Canada's largest government service companies, Themis Program Manageemnt and Consulting Ltd.  Chief Justice Lutfy ordered a public   hearing instead of the secret process these lawyers had asked for and expected to have granted.
